Justice Inyang Ekwo of the Federal High Court in Abuja declared the Peoples Democratic Party (PDP) primary election held on February 22, 2024, that produced Asue Ighodalo as its governorship candidate invalid.
The judgment was delivered in response to a suit marked FHC/ABJ/CS/165/2024, filed by aggrieved delegates, including one Kelvin Mohammed representing the group.
Justice Ekwo nullified the primaries, citing the unlawful exclusion of 378 delegates who were supposed to participate in the voting process.
The court ruled that the conduct of the primary election at the Samuel Ogbemudia Stadium in Benin violated both the Electoral Act 2022 and the PDP guidelines.
