Maxwell Opara, an Abuja-based legal practitioner, has filed a lawsuit against President Bola Tinubu at the Federal High Court in Abuja. Opara alleges lopsided appointments in the public sector, particularly in agencies under the Federal Ministry of Health, with no representation from the South East geo-political zone.
In the case marked FHC/ABJ/CS/218/2024, Opara named the Attorney General of the Federation (AGF) and the Federal Character Commission (FCC) as co-defendants.
The plaintiff contends that the appointments made on February 15th, 2024, by the President, violate the Federal Character principle outlined in Sections 4 and 5 of the Federal Character Commission Act and its guidelines.
Opara argues that the recent appointments disproportionately favour the northern zones, contradicting the requirement for equitable representation.
He seeks the court’s intervention to nullify the appointments and issue fresh ones that adhere to the Federal Character Act, ensuring fairness and compliance.
The plaintiff also urges the court to compel the President to respect the provisions of Sections 4 and 5 of the Federal Character Act. As of now, no date has been scheduled for the hearing of the case.
