The Supreme Court upheld Governor Peter Mbah’s election in Enugu State, affirming his victory, on Friday.
Justice Mohammed Garba, delivering the lead judgment, dismissed the claim that Mbah lacked a National Youth Service Corps (NYSC) certificate, labeling it as a mere allegation.
The court addressed all issues raised in the appeal against the appellant. Chijioke Edeoga of the Labour Party brought the case against INEC and Mbah, contesting the Court of Appeal’s decision to dismiss his challenge against the governor’s election.
The Lagos Division of the Appeal Court unanimously resolved three issues presented by Edeoga. Justice Tani Hassan, leading the three-member panel, concluded that the appellant failed to substantiate the claim that the respondent was ineligible for the gubernatorial election.
Regarding the accusation of over-voting, Justice Hassan pointed out that the voters’ register was not presented before the lower tribunal. This omission rendered the appeal inadmissible, emphasizing the importance of the voters’ register in the case.
