Court stops Babayo Misau from parading self as APC chairman in Bauchi

Bauchi State High Court Seven has issued an interim order, barring Babayo Misau from presenting himself as the substantive chairman of the All Progressives Congress (APC) in the state. This injunction remains effective until a Motion on Notice is heard and resolved.

The court’s decision stems from a legal dispute involving APC Concerned Citizens and Babayo Misau, alleging Misau’s violation of party regulations and actions contrary to the party’s achievements in the recent state governorship election. This legal action, suit No/BA/07/992/2023, was initiated by the plaintiffs, APC Concerned Citizens, against defendant Babayo Misau.

Representing the plaintiffs, Isa Mohammed filed a motion through a writ of summons, asserting that Misau had flouted party laws and worked against the party’s success in the 2023 governorship election. He highlighted Misau’s actions as contradictory to the party’s constitution and as contributing to the party’s failure in the election.

Isa Mohammed emphasized the necessity for justice by requesting the court to prevent Misau from acting as the APC Chairman until the substantive case is resolved, to prevent potential chaos among aggrieved party members.

Responding to these claims, Justice Lamido Kabir Umar presiding over the court granted the order restraining Babayo from holding himself out as the State chairman. The court also instructed the involved parties to expedite their case within 14 days, setting the motion on notice hearing for December 11, 2023.

It’s worth noting that the party had previously expelled Misau in April, accusing him of engaging in anti-party activities that undermined the party’s success during the general elections.
