The Abuja Court of Appeal has removed Musa Ilyasu Kwankwaso, an All Progressives Congress member, from his position and reinstated Yusuf Umar Datti of the New Nigeria People’s Party in the Kura/Madobi/Garun Malam Federal Constituency Election.
A three-panel, led by Justice Tunde Oyebamiji Awotoye, upheld an appeal filed by Yusuf Datti, asserting that the tribunal erred by considering the date of the appellant’s resignation as the date of his party’s primary election.
They also noted that Section 77 of the Electoral Act was misapplied, emphasizing that no court holds jurisdiction over matters related to party membership.
